1.5 ARE PERSONAL DATA TRANSFERRED TO ANOTHER COUNTRY AND ARE PERSONAL DATA PASSED ON TO OTHER COMPANIES?
The website is located on a server in the European Union (EU), data processed by Distrelec, will not be transferred outside the European Union.
With regard to third-party tools and products we use provided by Google Ireland Ltd., please note that some pseudonymised or anonymised data collected by Google Analytics and processed by Google Ireland Ltd, might, occasionally, be transferred by Google Ireland Ltd to Google LLC or another of the Google entities, based outside of the European Union in so-called third countries. 1.6 HOW LONG ARE PERSONAL DATA STORED?
We will store your personal data only for as long as is necessary for the purposes described in this Privacy Policy. At your request, your personal data will be erased within 30 days of your request for erasure being reviewed, unless statutory obligations stipulate otherwise.

2 Distrelec AND COOKIES
Our websites and mobile sites use cookies to improve your online experience. We use strictly necessary cookies that are essential for you to browse the website and use its features, such as accessing secure areas of the site. Furthermore, we use not strictly necessary cookies. 2.10 Lead Forensics
This website uses Lead Forensics, a B2B sales and marketing enablement tool. It is operated by Lead Forensics, UK Headquarters, Communication House, 26 York Street, London, W1U 6PZ, UK.The Lead Forensics tool uses a tracking code for identifying businesses visiting our websites based on their business IP addresses. This is not the same as cookies. The Lead Forensics tracking code only provides information that is readily available in the public domain. It does not, and cannot, provide personal or sensitive data regarding who has visited our website. Under no circumstances will the data be used for the personal identification of an individual visitor. If IP addresses are collected, they will be anonymised immediately after collection. The information generated by the Lead Forensics tracking code is transmitted to the Lead Forensics tool and processed and stored in the UK within a secure environment.

The Lead Forensics tool does not provide us with the IP addresses. It provides us information on what companies have visited our website, the date and duration of their visit, and the web pages that they visit. This information allow us to analyse the use of our website and eventually contact those companies about their experience or for sales purposes. As an international company, to be able to guaranty you the best service, we transmit this data to our subsidiaries and distributors as far as necessary. Beyond this purpose, there is no transmission of personal information to third parties.

3.2 DEFINITION OF PERSONAL DATA AND INFORMATION ON PROCESSING
Personal data is defined in the GDPR as follows: ‘ Personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data or an online identifier, or to one or more features specific to the person’s physical, physiological, genetic, mental, economic, cultural or social identity.’

The data controller may process the following data which you have provided to the data controller by registering with the online shop (hereinafter the ‘Distrelec online shop’):
(i) title, first name, surname;
(ii) eMail address;
(iii) postal address;
(iv) job role and information about the company you work for (if applicable);
(v) contact number ( e.g. telephone, mobile and/or fax number);
(vi) industry;
(vii) When you register with the Distrelec online shop, further details may be required or may be provided voluntarily.

The other data listed above is provided voluntarily; however, if you

3.3 PURPOSE OF PROCESSING, RELEVANT LEGAL BASIS

a. Responding to your enquiries
The Data Controller will process your Data listed under paragraph 3.2 above to follow up the requests you might have made in order to register to Distrelec online shop and to take advantages of services, features and tools provided for therein. By way of example, your Data is processed to provide you with (i) the access to Distrelec online shop, (ii) the chance to purchase the goods/services available therein (or to place an order), and (iii) the assistance and the support you might need in the context of you registering to or using Distrelec online shop. Please note that a registration for the Distrelec online shop and creation of an user account is non-mandatory, you can also place an order using our guest checkout, especially if you are acting in your capacity as a consumer, for further in formation on data processed in relation with orders you place, please see paragraph 4.2 and 4.4 below.

The data controller has no intention of making your data available to the public.

3.5 DATA TRANSFER TO THIRD COUNTRIES
Your data may also be transferred for the above purposes to other legal entities that are part of the group of companies to which the data controller belongs (e.g. to the group company that enters into the contractual relationship with you when you place an order, to companies within the Group that provide IT support services, and/or companies that provide services necessary or relevant to delivery of the products/services you have purchased, or to third companies established in countries outside the European Economic Area that provide services relevant to the processing of data by the data controller.

The mentioned transfer, whether the case be, shall take place only if the requirements provided for by the Regulation are fulfilled. In particular, on a case-by-case basis, the transfer might take place upon an adequacy decision issued by the European Commission, by the adoption of standard contractual clauses and/or upon any other appropriate safeguard provided for by the Regulation being implemented. 3.6 APPLICABLE RETENTION PERIOD
The data controller has a basic obligation to ensure that your data are processed only for as long as is strictly necessary for the purposes specified in section 3.3.

Below you will find information on the envisaged retention period for the specific processing purposes:
a) To respond to your enquiries, your data are processed as long as you are registered with the Distrelec online shop, i.e. until you decide to delete the account you have created. After that, your data are stored only for a period of 24 months after deletion of the account, in order to comply with statutory provisions or to defend the rights of the data controller;

b) To comply with legal obligations, your data are processed and stored by the data controller for the time necessary to comply with said legal obligations;

c) For the purpose of sending customer satisfaction messages, your data are processed for as long as is strictly necessary to request your feedback after you have placed an order or performed a particular action in the Distrelec online shop (this message is generally sent no later than one month after the relevant order or particular action you have performed in the Distrelec online shop); as soon as a customer satisfaction message is sent relating to an order you have placed or a specific action you may have performed, you will not receive any further messages of this kind with regard to that order/action. If you submit another order/perform other important actions in the Distrelec online shop, you may receive a new customer satisfaction message. You can decide to unsubscribe from this type of communication at any time and free of charge by exercising your right of withdrawal via the dedicated link that you will find in the footer of any customer satisfaction message you may receive. d) Subject to your consent, your data are processed for marketing purposes in accordance with section 3.3 (d) above for as long as you are registered with the Distrelec online shop (i.e. until you decide to delete the account you have created), and for 24 months thereafter. In this context, the data controller can only take into account the preferences you have indicated over the past 12 months in order to send you promotional material and/or invitations that may be of interest to you. This is without prejudice to your right to revoke at any time and free of charge your previously granted consent concerning the receipt of marketing and advertising messages/invitations that may be of interest to you;

e) For statistical analysis purposes, if such data fall within the definition of data in this context, your data will be processed only for the time strictly necessary to achieve those purposes. As a basic principle, the data controller undertakes to anonymise the data (or at least to pseudonymise them or take similar appropriate security measures) and to process only aggregated information as far as possible. Reports contain anonymous information only, whatever the case. No retention period is specified for reports that contain anonymous information only.

3.7 YOUR RIGHTS AS A DATA SUBJECT
As long as the data controller is in possession of your data or processes them, you as a data subject have the following rights at all times:
  • Right to information – You have the right to request information about whether your data are processed or not, and if so, the right to access the data and to obtain full details of such processing;
  • Right of rectification – You have the right to request rectification of your data immediately if they are incorrect or incomplete;
  • Right to erasure – If the conditions stipulated in the GDPR are met, you have the right to request erasure of your data from our records;
  • Right to restriction of processing – If certain conditions are met, you have the right to request the data controller to restrict processing;

Most of your details were gathered by Distrelec Manchester Ltd. with registered office at 7th Floor, 2 St. Peter’s Square, Manchester, M2 3AA, UK when you created/registered an account in the Distrelec online shop.

These data are disclosed to the data controller when you place an order that is relevant to products/services sold by the data controller through the Distrelec online shop or, more generally, for purchases for which the data controller manages the contractual relationship and relevant delivery.

4.4 PURPOSE OF PROCESSING, RELEVANT LEGAL BASIS

a. Follow up your orders, pre-contractual ordinary checks and management of the contractual relationship, guest checkout
The Data Controller will process your Data listed under paragraph 4.2 above to follow up your orders, carry out pre-contractual ordinary checks, satisfy requests you might have made and manage the relevant contractual relationship with you. 4.7 APPLICABLE RETENTION PERIOD
The data controller has a basic obligation to ensure that your data are processed only for as long as is strictly necessary for the purposes specified in section 4.4.

Below you will find information on the envisaged retention periods for the specific processing purposes:

a) To respond to your enquiries, your data are processed for as long as a contractual relationship exists between you and the data controller, i.e. until the price for the products/services purchased and delivered or provided has been successfully paid to the data controller and there are no outstanding payments. After that, your data are stored for a period of 11 years in order to comply with statutory obligations or to defend the rights of the data controller;

b) To comply with legal obligations, your data are processed and stored by the data controller for the time necessary to comply with said legal obligations;

c) For the purpose of sending customer satisfaction messages, your data are processed for as long as is strictly necessary to request your feedback after you have placed a particular order or made a purchase, or to receive your feedback on the products/services you have ordered/purchased (this message is generally sent no later than one month after your most recent order or your most recent purchase). As soon as you receive a customer satisfaction message relating to a particular order, purchase made by you or to the products/services your ordered/purchased, you will not be sent any further messages of this of kind with regard to said order/purchase or the relevant products/services you ordered/purchased. If you submit another order or purchase other products/services, you may receive a new customer satisfaction message. 4.8 YOUR RIGHTS AS A DATA SUBJECT
As long as the data controller is in possession of your data or processes them, you as a data subject have the following rights at all times:

  • Right to information – You have the right to request information about whether your data are processed or not, and if so, the right to access the data and to obtain full details of such processing;
  • Right of rectification – You have the right to request rectification of your data immediately if they are incorrect or incomplete;
  • Right to erasure – If the conditions stipulated in the GDPR are met, you have the right to request erasure of your data from our records;
  • Right to restriction of processing – If certain conditions are met, you have the right to request the data controller to restrict processing;
  • Right to data portability – You have the right to have the stored data concerning you transmitted to another data controller;
  • Right to object – You have the right to object at any time, on grounds relating to your particular situation, to the processing of your data based on the legitimate interest of the data controller, including profiling, unless the data controller demonstrates compelling legitimate reasons for the processing which override the interests, rights and freedoms of the data subject, or in order to establish, exercise or defend legal claims;
  • Right to withdraw consent – You have the right to withdraw at any time your previously granted consent to the processing of your data, provided that the withdrawal of consent is without prejudice to the legality of processing based on the consent granted before withdrawal;
  • The right to lodge a complaint with the supervisory authority – If the data controller refuses to comply with a request you make in exercising your rights under the GDPR, the controller will inform you of the reason for this refusal. If necessary, you have the right to lodge a complaint in accordance with the following section.
