We have implemented the ‘Shariff solution’ to protect your personal data. Only if you click on the ‘+ 1’ or ‘f’ or ‘thumbs up’ button will your browser set up a direct connection to the servers at Facebook or Google. The content of the ‘+ 1’ or ‘f’ or ‘thumbs up’ button is then passed on by Google or Facebook directly to your browser, which integrates it into the website. We therefore have no control over the amount of data gathered using the respective Google or Facebook buttons.

2.10 Lead Forensics
This website uses Lead Forensics, a B2B sales and marketing enablement tool. It is operated by Lead Forensics, UK Headquarters, Communication House, 26 York Street, London, W1U 6PZ, UK.The Lead Forensics tool uses a tracking code for identifying businesses visiting our websites based on their business IP addresses. This is not the same as cookies. The Lead Forensics tracking code only provides information that is readily available in the public domain. It does not, and cannot, provide personal or sensitive data regarding who has visited our website. Under no circumstances will the data be used for the personal identification of an individual visitor. If IP addresses are collected, they will be anonymised immediately after collection. The information generated by the Lead Forensics tracking code is transmitted to the Lead Forensics tool and processed and stored in the UK within a secure environment.

The Lead Forensics tool does not provide us with the IP addresses. It provides us information on what companies have visited our website, the date and duration of their visit, and the web pages that they visit. This information allow us to analyse the use of our website and eventually contact those companies about their experience or for sales purposes. As an international company, to be able to guaranty you the best service, we transmit this data to our subsidiaries and distributors as far as necessary. Beyond this purpose, there is no transmission of personal information to third parties.

2.11 Protection against spam/DDoS attacks
Provided you have granted us consent via the cookie banner, we use tools (such as Google reCAPTCHA and others) to protect our website from malicious traffic, in particular to protect it against spam and DDoS attacks. These types of service analyse your surfing behaviour on the website, the configuration of your computer (including cookies from Google or other third parties that have already been set) and your IP address to determine whether you are a genuine user or a malicious user. 4.2 DEFINITION OF PERSONAL DATA AND INFORMATION ON PROCESSING
Personal data is defined in the GDPR as follows: ‘ Personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data or an online identifier, or to one or more features specific to the person’s physical, physiological, genetic, mental, economic, cultural or social identity.’ (hereinafter the ‘data’).

The data controller processes the following data gathered by it in order to provide you with the goods or services that you have ordered/purchased via the Distrelec online shop, and in the context of customer service activities:
(i) title, first name, surname;
(ii) eMail address;
(iii) postal address;
(iv) credit card details or information about the payment methods you have used to pay;
(v) contact number ( e.g. telephone, mobile and/or fax number);
(vi) job role and information about the company you work for (if applicable);
(vii) industry;
(viii) any other data required or which you have voluntarily sent to the data controller in connection with (a) an order or purchase made by you, (b) activities ancillary to those necessary to provide the product or service you have purchased or ordered, or (c) the measures that the data controller may take in order to check your creditworthiness and/or to prevent fraud.

The above data are provided is for the purpose of initiating and implementing a contract and for the rest is voluntary; if, however, you:

• refuse to provide the data referred to in items (i) – (iv) above, the data controller will be unable to process an order submitted by you and/or supply you with the products or services in which you are interested or which you have purchased/ordered;
• decide not to provide the data in item (v) above, the data controller will be unable to contact you by telephone (and/or fax) if you need assistance in connection with an order or purchase, to provide you with customer service activities, or generally to provide you with services and/or notifications that may be of interest to you;
• the data in point (viii) are not provided. Depending on the type of information missing, the data controller may be unable to conclude the contract with you or to provide you with the goods or services you may have requested or need.

In any event, the data controller shall ensure that the information gathered and processed is adequate for the purposes described here and does not constitute an invasion of your privacy.

4.3 DATA SOURCE
Most of your details were gathered by Distrelec Manchester Ltd. with registered office at 7th Floor, 2 St. Peter’s Square, Manchester, M2 3AA, UK when you created/registered an account in the Distrelec online shop.

These data are disclosed to the data controller when you place an order that is relevant to products/services sold by the data controller through the Distrelec online shop or, more generally, for purchases for which the data controller manages the contractual relationship and relevant delivery.

Other data (e.g. details of the credit card used for payment) that you need in order to submit an order may be gathered directly on the checkout page.

4.4 PURPOSE OF PROCESSING, RELEVANT LEGAL BASIS

a. Follow up your orders, pre-contractual ordinary checks and management of the contractual relationship, guest checkout
The Data Controller will process your Data listed under paragraph 4.2 above to follow up your orders, carry out pre-contractual ordinary checks, satisfy requests you might have made and manage the relevant contractual relationship with you. In particular, your Data might be processed in the context of the activities necessary or related to client engagement and administration, performance of checks prior to the entering into the contract with you aimed at assessing your credit standing/creditworthiness and at preventing frauds, order management, delivery of products/services you might have ordered, invoice issuing, payment collections, after sales and technical assistance or customer care activities in general, etc. If you have not registered for our online shop and placed an order in our Distrelec online shop using our guest checkout, we process the Data pursuant to paragraph 4.2 that is required to fulfil and process your order.

The legal basis for the processing of your data is the fulfilment of a contract concluded with you, or responding to your enquiries prior to conclusion of a contract.

b. Compliance with statutory obligations
Where necessary, the data controller will process your data in order to comply with statutory obligations (including those stipulated by the Anti-Money Laundering Directive) relating to management of the contractual relationship with you and, in general, to activities necessary to respond to your enquiries.

Providing your data for this purpose is mandatory.

c. Sending customer satisfaction messages
If you purchase products and/or services via the Distrelec online shop, by telephone or by eMail, the data controller may process your data in order to send you messages aimed at assessing your satisfaction with a particular order/purchase or with the products/services you may have ordered or purchased, and in general to ask whether you enjoyed that shopping experience. This would help the data controller to improve the quality of the services provided.

This (i.e. sending the customer satisfaction messages listed below) can only be done by the data controller if you have granted your prior consent, as this is the legal basis for processing the data.

Please note in this regard that you can decide at any time and free of charge to withdraw your previously granted consent to the processing of your data for the specified purpose, either by clicking on the link provided for this purpose in the footer of every message sent to you, or by contacting the data controller using the contact details provided below and in the manner indicated below. If you exercise the right to withdraw your consent, the data controller will be unable to send you any further customer satisfaction messages in future that relate specifically to a purchase/order.

d. Statistical analysis (i.e. generation of business reports at company level)
The data controller may conduct statistical analyses of purchases, orders and other sales activities performed via the Distrelec online shop or in some other manner.

Information is then stored anonymously and processed as an entirety. Therefore, these activities do not include the processing of data which qualify as data by which you can be personally identified.

If and insofar as your data are processed, security measures must be implemented to protect your data (e.g. pseudonymisation). The respective processing is performed by the data controller, where relevant, on the basis of its legitimate interest.

4.5 DISCLOSURE OF YOUR DATA TO THIRD PARTIES DOMICILED IN THE EU
The data controller may disclose your data to third parties who provide the data controller with services which are necessary in order to meet your request(s) and/or which relate to the management of processes relevant to the aforementioned purposes.

Your data may be disclosed, in particular, to organisations that are either members of the corporate groups to which the data controller belongs, or not, that support the data controller in managing the contractual relationship with you, that perform pre-contractual checks regarding your creditworthiness and/or for fraud prevention prior to conclusion of contract, that supply the products/services purchased by you, that issue the respective invoices or provide additional services to the data controller in respect of these activities, including IT service providers and/or external consultants in general. Your data may also be disclosed to other legal entities within the Group for the purpose of sending customer satisfaction messages relating to a particular purchase you have made or order you have submitted, and these entities process the data on behalf of the data controller.

These third parties process your data in their capacity as data processors.

We conclude contracts in accordance with Article 28 (3) GDPR with any companies that process data on our behalf, thus ensuring that the processors comply with the rules laid down in the GDPR.

The data controller keeps the list of data processors up to date. You can access that list by contacting the data controller at the eMail address provided above.

The data controller may also disclose your data to third parties to which there is a legal obligation to disclose such data, to public authorities, to other legal entities within the Group to which the data controller belongs and which are established within the European Economic Area (and in particular to Group companies responsible for providing services and/or delivering products that you have ordered/purchased), to financial institutions used by the data controller for payments and/or to other financial institutions.

The data controller has no intention of making your data available to the public.

4.6 DATA TRANSFER TO THIRD COUNTRIES
Your data may also be transferred for the above purposes to other legal entities that are part of the group of companies to which the data controller belongs (e.g. to companies within the Group that provide IT support services, and/or to companies that provide services necessary or relevant to delivery of the products/services you have purchased), or to third companies established in countries outside the European Economic Area that provide services relevant to the processing of data by the data controller.

The mentioned transfer, whether the case be, shall take place only if the requirements provided for by the Regulation are fulfilled. In particular, on a case-by-case basis, the transfer might take place upon an adequacy decision issued by the European Commission, by the adoption of standard contractual clauses and/or upon any other appropriate safeguard provided for by the Regulation being implemented. For our use of Google Analytics and transfers that may occur in this respect from Google to third countries please find detailed information on such transfer and safeguards in place in section 2.8 above.

We conclude contracts in accordance with Article 28 (3) GDPR with any companies that process data on our behalf, thus ensuring that the processors comply with the rules laid down in the GDPR.

4.7 APPLICABLE RETENTION PERIOD
The data controller has a basic obligation to ensure that your data are processed only for as long as is strictly necessary for the purposes specified in section 4.4.

Below you will find information on the envisaged retention periods for the specific processing purposes:

a) To respond to your enquiries, your data are processed for as long as a contractual relationship exists between you and the data controller, i.e. until the price for the products/services purchased and delivered or provided has been successfully paid to the data controller and there are no outstanding payments. After that, your data are stored for a period of 11 years in order to comply with statutory obligations or to defend the rights of the data controller;

b) To comply with legal obligations, your data are processed and stored by the data controller for the time necessary to comply with said legal obligations;

c) For the purpose of sending customer satisfaction messages, your data are processed for as long as is strictly necessary to request your feedback after you have placed a particular order or made a purchase, or to receive your feedback on the products/services you have ordered/purchased (this message is generally sent no later than one month after your most recent order or your most recent purchase). As soon as you receive a customer satisfaction message relating to a particular order, purchase made by you or to the products/services your ordered/purchased, you will not be sent any further messages of this of kind with regard to said order/purchase or the relevant products/services you ordered/purchased. If you submit another order or purchase other products/services, you may receive a new customer satisfaction message. You can decide, at any time and free of charge, to unsubscribe from this type of communication relating to a particular order, purchase made by you or products/services ordered/purchased by you, by exercising your right of withdrawal via the dedicated link that you will find in the footer of any customer satisfaction message you may receive. In this case, the data controller will no longer process your data for this purpose in future;

d) For statistical analysis purposes, if such data fall within the definition of data in this context, your data will be processed only for the time strictly necessary to achieve those purposes. As a basic principle, the data controller undertakes to anonymise the data (or at least to pseudonymise them or take similar appropriate security measures) and to process only aggregated information as far as possible. Reports contain anonymous information only, whatever the case. No retention period is specified for reports that contain anonymous information only.

As long as the data controller is in possession of your data or processes them, you as a data subject have the following rights at all times:
